2013 High School Slam Dunk & 3-Point Bracket Contest

Official Rules

The High School Slam Dunk & 3-Point Bracket Contest (the “Contest”) starts on January 18, 2013 at 12:00 p.m. Central Time (“CT”) and ends on March 20, 2013 at 11:59 a.m. CT (“Contest Period”).

ELIGIBILITY: Contest is open to High School students who are on track to graduate at the end of the 2012-2013 school year, 16 years of age and older, and a legal resident of the forty-eight (48) contiguous United States and District of Columbia. Employees of American Family Insurance (“Sponsor”), and contest administrators, Intersport, Inc. (“Administrator”) CBS Television, MaxPreps, and their respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void where prohibited by law. Contest is subject to all applicable federal, state and local laws.

HOW TO ENTER: During the initial phase of the Contest Period commencing on January 18, 2013 at 12:00 p.m. CT and continuing through January 29, 2013 at 5:00 p.m. CT (“Submission Period”), visit www.facebook.com/highschoolslam and follow the directions provided to complete the entry procedure and upload a video for consideration for one of the two (2) contest brackets: (1) men’s 3-point shot, and (2) slam dunk, and submit (collectively with video “Entry”). Only men can enter the men’s 3-point-shot bracket. The video for the men’s 3-point shot bracket should include the entrant shooting 3 point basketball shots. The video for the slam dunk bracket should contain the entrant dunking the basketball. All online Entries must be received by January 29, 2013 at 5:00 pm CT to be considered. Entries generated by script, macro or other automated means or by any means which subvert the entry process are void. Limit one (1) Entry per person per bracket. Entries received from any person in excess of the limitation will be void.

REQUIREMENTS OF ENTRIES:
Entry may not contain, as determined by the Administrator, in its sole discretion, any content that:

Entry must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the Entry contains any material(s) or element(s) that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor and/or Administrator in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry, necessary music licenses, etc. Administrator reserves the right to request proof of these permissions in a form acceptable to Administrator from any entrant at any time. Failure to provide such proof may, if requested, render Entry null and void. By submitting an Entry, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein.

By submitting an Entry, entrant acknowledges and agrees that Administrator shall have the right to edit or alter the Entry in any manner the Administrator deems necessary in its sole discretion, including, without limitation, replacing music,, adding content/text regarding the official Contest information and directions for the Voting Periods (see Voting section below) and/or adding other Administrator related elements.

By submitting an Entry, entrant acknowledges and agrees that Sponsor and/or Administrator may obtain many Entries in connection with this Contest and/or other contests staged and/or promoted by the Administrator, and that such Entries may be similar or identical in theme, idea, format or other respects to other Entries submitted in connection with this Contest and/or other contests sponsored by the Sponsor, administrated by the Administrator, or submitted for other reasons or other materials developed by the Administrator. Entrant waives any and all claims entrant may have had, may have, and/or may have in the future, that any Entry and/or other works accepted, reviewed and/or used by the entrant may be similar to his/her Entry, or that any compensation is due to entrant in connection with such Entry or other works used by Sponsor and/or Administrator.

By submitting an Entry, entrant hereby grants permission for the Entry to be posted on www.facebook.com/highschoolslam or other websites. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry. Entrants agree that they will not use the Entry for any other purpose, including, without limitation, posting the Entry to any online social networks, without the express consent of Administrator in each instance.

JUDGING: All eligible Entries received by Administrator during the Submission Period will be judged by a panel of qualified judges based on the following criteria: Creativity: 50%, Difficulty 35% Accuracy/Consistency: 15% The thirty-two (32) Entries (sixteen (16) for the Men 3-point category; and sixteen (16) for the slam dunk category (each individually a “Category” and collectively “Categories”)) with the highest score will be deemed Finalists and will move into the Phase One Voting Period, subject to verification. Finalists will be seeded within each Category at Administrator’s sole discretion. In the event of a tie, an additional, “tie-breaking” judge will determine the winner(s) based on the criteria listed herein per applicable bracket. Administrator reserves the right to choose fewer than sixteen (16) finalists per Category if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries. Prize awards are subject to verification of eligibility and compliance with these Official Rules.

FINALIST NOTIFICATION: Judges’ and Administrator’s decisions are final and binding on all matters relating to this Contest. Potential Finalists will be notified by telephone, and/or email and may be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents required by Administrator, which must be returned within two (2) days of the date appearing on prize notification. Return of prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Administrator to contact a potential Finalist within a reasonable time period or noncompliance with these Official Rules by any potential Finalist will result in disqualification and, at Administrator’s sole discretion, the opportunity to be a Finalist may be awarded to a runner-up. Subject to verification of eligibility and compliance with these Official Rules, the finalist that receives the highest number of valid votes, as determined by Administrator, will be deemed the Finalist of that applicable Voting Period. Use of script, macro or any automated system to vote or with the intent to impair the integrity of the voting process in any Voting Period is prohibited and all such votes will be void. If any potential Finalist/winner is an eligible minor in his/her jurisdiction of residence, Administrator reserves the right to award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein.

VOTING: There will be a bracket for the men’s 3-point shot and the slam dunk. Each bracket will have sixteen (16) contestants with eight (8) match-ups initially. The brackets will be seeded in the Administrator’s sole discretion.

Phase One Voting Period: Finalists’ Entries will be featured at www.facebook.com/highschoolslam between 12:00 p.m. CT on February 6, 2013 and 11:59 a.m. CT on February 20, 2013 (“Phase One Voting Period”). During the Phase One Voting Period, individuals will be invited to visit www.facebook.com/highschoolslam where they will be given directions to vote, and may vote one (1) time per match-up per bracket, per day. Limit sixteen (16) votes per person and/or facebook account, per day during the Phase One Voting Period. Votes received from any person and/or facebook account in excess of the stated limitation will be void. Subject to verification of eligibility and compliance with these Official Rules, the entrant with the most votes per match-up, as determined by Administrator, will be deemed a Finalist of the Phase One Voting Period, and will have the opportunity to move to the Phase Two Voting Period.

Phase Two Voting Period: Finalists’ Entries will be featured at www.facebook.com/highschoolslam between 12:00 p.m. CT on February 20, 2013 and 11:59 a.m. CT on February 27, 2013 (“Phase Two Voting Period”). During the Phase Two Voting Period, individuals will be invited to visit www.facebook.com/highschoolslam where they will be given directions to vote and may vote one (1) time per match-up, per bracket, per day. Limit eight (8) votes per person and/or facebook account per day during the Phase Two Voting Period. Votes received from any person and/or facebook account in excess of the stated limitation will be void. Subject to verification of eligibility and compliance with these Official Rules, the entrant with the most votes per match-up, as determined by Administrator, will be deemed the Finalist of the Phase Two Voting Period, and will have the opportunity to move on to the Phase Three Voting Period.

Phase Three Voting Period: Finalists’ Entries will be featured at www.facebook.com/highschoolslam between 12:00 p.m. CT on February 27, 2013 and 11:59 a.m. CT on March 6, 2013 (“Phase Three Voting Period”). During the Phase Three Voting Period, individuals will be invited to visit www.facebook.com/highschoolslam where they will be given directions to vote, and may vote one (1) time per match-up, per bracket, per day. Limit four (4) votes per person and/or facebook account, per day during the Phase Three Voting Period. Votes received from any person and/or facebook account in excess of the stated limitation will be void. Subject to verification of eligibility and compliance with these Official Rules, the entrant with the most votes per match-up, as determined by Administrator, will be deemed the Finalist of the Phase Three Voting Period, and will have the opportunity to move to the Phase Four Voting Period.

Phase Four Voting Period: Finalists’ Entries will be featured at www.facebook.com/highschoolslam between 12:00 p.m. CT on March 6, 2013 and 11:59 a.m. CT on March 20, 2013 (“Phase Four Voting Period”). During the Phase Four Voting Period, individuals will be invited to visit www.facebook.com/highschoolslam where they will be given directions to vote, and may vote one (1) time per match-up, per bracket, per day. Limit two (2) votes per person and/or facebook account per day during the Phase Four Voting Period. Votes received from any person and/or facebook account in excess of the stated limitation will be void. Subject to verification of eligibility and compliance with these Official Rules, the entrant with the most votes per match-up, as determined by Administrator, will be deemed the Finalist of the Phase Four Voting Period, and the potential Grand Prize winner of that Category. At the conclusion of the Phase Four Voting Period, the top two (2) Entrants (one (1) from each Category) with the highest number of votes will be deemed the Grand Prize winners and will be announced on www.facebook.com/highschoolslam on March 20, 2013 at 12:00 p.m. CT.

Use of script, macro or any automated system to vote or with the intent to impair the integrity of the voting process in any Voting Period is prohibited and all such votes will be void. Finalists in any Voting Period are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Administrator in its sole discretion.

GRAND PRIZE: Three (3): A trip for winner and one (1) Guest to Atlanta, GA from April 4, 2013 to April 6, 2013 where the winner will compete in the High School Slam Dunk and 3-Point Championships event (“Event“) as a dunker or three-point shooter (depending on which bracket contest they won). Trip consists of roundtrip, coach class air transportation from a major U.S. gateway airport nearest winner’s residence to Atlanta, GA, three (3) days and two (2) nights standard hotel accommodations (one room, double occupancy), and necessary ground transportation for participation in the High School Slam Dunk and 3-Point Championships event (“Event“) . Ground transportation to and from the airports is not included. If winner resides within a 100-mile radius of destination, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof. Approximate Retail Value (“ARV”): $1,800/each. Total value of all prizes to be awarded: $3,600. Actual value of prize may vary based on point of departure. Any difference between stated value and actual value will not be awarded. Trip must be taken on dates specified by Administrator and winner must participate in Event, or prize will be forfeited and neither Sponsor nor Administrator will have no further obligation to such winner. Administrator reserves right to change dates. Winner and guest must travel together on the same itinerary. Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18), and must sign a liability/publicity release prior to issuance of travel documents. If winner is a minor, Guest must be winner’s parent or legal guardian. Travel must be made through Administrator’s agent, on a carrier of Administrator’s choice. All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided, including transportation to and from the airports; meals, souvenirs, gratuities, luggage fees are the sole responsibility of the winners. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Administrator or Sponsor. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Administrator reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Administrator’s sole discretion.

GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Administrator and judges, which shall be final and binding in all respects relating to this Contest; (b) to release, discharge and hold harmless Sponsor, Administrator, CBS, MaxPreps, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any awarded prize including any travel/activity related thereto; and (c) to the use of his/her name, voice, performance, photograph/video, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and their designees including, but not limited to Administrator, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so. By participating, entrant also agrees not to release any publicity or other materials on their own or through someone else regarding their participation in the Contest without the prior consent of the Administrator, which it may withhold in its sole discretion. 

OWNERSHIP/USE OF ENTRIES: By submitting an Entry, each entrant agrees Sponsor and Administrator shall be granted all necessary rights to the Entry submitted (including all rights embodied therein) so that it and its designees may exploit, edit, modify, and distribute the Entry and all elements of such Entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, worldwide, in perpetuity without compensation, permission or notification to entrant or any third party.

MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled Entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Entries, the tabulation of votes, the announcement of the prizes, the incorrect uploading of the video or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Administrator, will be disqualified and all associated Entries will be void. Should any portion of the Contest be, in Administrator’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Administrator, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Administrator reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect Entries received prior to action taken using the judging procedure outlined above. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
